Olivier Martinez makes serious accusation against Halle Berry: “She grabbed my son by the neck and started choking him”
The former couple’s long-running dispute has escalated

A years-long dispute between Halle Berry and Olivier Martinez has escalated into one of its most serious chapters yet, with Martinez accusing his former wife of physically attacking their son and seeking emergency court intervention.
Martinez alleged in court documents that the September 26 incident began while Maceo was playing with virtual reality goggles. He claimed Berry criticized their son before the disagreement became physical.
“The situation escalated and Petitioner jumped on our son and started physically fighting with him,” Martinez alleged. “She grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now?! Who is dominant?!’”
Berry denies the allegation. Her attorney, Marina Beck , called Martinez ’s filing “entirely meritless and deliberately misleading” and accused him of his own history of violating court orders involving their son.
Maceo contacted Martinez after alleged incident
According to Martinez ’s filing, Maceo reached out to him immediately after the alleged confrontation and asked to be collected from Berry’s home.
Text messages included with the court documents reportedly showed Maceo writing, “come pick [me] up right now,” before later asking, “Are u here please come.”
Martinez claimed the boy was left “traumatized” and no longer wanted to stay at his mother’s home.
He also alleged that Berry had engaged in physical confrontations with Maceo on previous occasions, including wrestling him to the ground and forcing him to “tap out.”
A restraining order was granted Thursday, with Martinez receiving primary custody. Berry ’s previous 50/50 arrangement was replaced by court-ordered daytime visits two days per week and every other weekend.
Berry was also ordered to remain at least 100 yards away from Martinez . Their next court date is scheduled for October 16.
Berry strongly disputes Martinez account
Beck responded by arguing that the wider history of the custody dispute tells a very different story.
“There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo,” she said.
Beck also alleged that Martinez has demonstrated “erratic, possessive and violent behavior” over the years.
“Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs,” the statement concluded.
Berry and Martinez married in 2013 and separated in 2015, but their divorce took eight years to finalize.
The former couple’s latest court battle now centers on sharply conflicting accounts of what happened inside Berry ’s home, with Martinez making serious allegations and Berry ’s legal team categorically rejecting them.
