Clancy trial collapses: Judge declares mistrial following rejected 11th-hour defense maneuver

A last-minute defense appeal failed after jurors remained divided over Clancy’s criminal responsibility

Lindsay Clancy’s murder trial ended in a mistrial Friday after jurors failed to reach a unanimous verdict, bringing a closely watched case to an abrupt conclusion after nearly six weeks of testimony.

Plymouth Superior Court Judge William Sullivan declared the mistrial after the 12-person jury delivered its third deadlock notice. The panel had spent more than 38 hours deliberating over seven days but remained unable to agree on whether Clancy was criminally responsible for the deaths of her three children.

The dramatic conclusion followed a last-minute legal effort by defense attorney Kevin Reddington. He argued that a lone holdout juror was refusing to properly apply the court’s instructions on reasonable doubt and asked that the juror be removed. Sullivan had already questioned jurors individually and determined they could follow his instructions.

When Sullivan moved toward declaring a mistrial, Reddington requested time to seek emergency intervention from the Massachusetts Supreme Judicial Court. The judge granted him one hour, but the appeal was ultimately rejected, allowing the mistrial to proceed.

The case centered on the January 2023 deaths of Cora, 5, Dawson, 3, and Callan, 8 months . Clancy , a former labor and delivery nurse, admitted through her defense that she killed the children but pleaded not guilty by reason of insanity.

The defense maintained that she was suffering from severe postpartum psychosis, which left her detached from reality and hearing a male voice she believed was directing her actions.

The prosecution offered a starkly different interpretation.

Prosecutors acknowledged that Clancy had experienced serious mental-health problems but argued that she understood what she was doing and deliberately carried out the killings. They pointed to evidence surrounding her husband’s departure from the home shortly before the deaths as evidence that she had planned her actions.

The trial also featured emotional testimony from Patrick Clancy , who described his former wife’s worsening condition during the months after the birth of their third child. He testified about her insomnia, anxiety, depression, suicidal thoughts and repeated efforts to obtain psychiatric care.

What happens after the mistrial?

Friday’s ruling doesn’t mean Clancy has been cleared of the charges. She’ll remain in state custody while prosecutors determine how to proceed. A retrial is possible, although prosecutors could also consider a plea agreement or decide not to pursue the case again.

A status conference is scheduled for September 29, when the next steps are expected to become clearer.

For now, there’s no verdict. After weeks of testimony and days of tense deliberations, the question of Clancy’s criminal responsibility remains unresolved.
